My husband and i have 3 little boys. He also has a 7 year old son from a previous relationship. We have twice been contacted by child protective services this year. The last time it was because someone reported her as being an alcoholic and meth user. She is not complying with the DFS and will not take a drug test. When the case worker went in her home, she reported it was filthy, had no beds to sleep on, reeked of urine and had a limited food supply. His son also told the caseworker mom smoked regular cigs and not weed and that she drinks whiskey. The boy is not in regular school, but homeschooled..which he doesnt do regularly. He is with a babysitter or an hour away with his grandfather most of the time stating mommy works alot. his clothes are never the right size and when we pick him up hes never wearing underwear. We can provide him with a home, clothes, bed, education, food, and a better life...do we have a chance to win custody or are we fighting a losing battle?
Go to the Family Court division of the superior court and file an Order to Show Cause Regarding Modification of Child Custody. Its not complicated to fill out and there are sections regarding child visitation. In your declarations, state your concerns and reasons why you believe a change of custody is important for the welfare of the children. Get records from DFS to attach as exhibits. Request that the mother be drug tested prior to any visition.
